Michigan Supreme Court ruling on marijuana use during state probationThe Michigan Supreme Court recently ruled that judges generally cannot prohibit lawful marijuana use as a condition of Michigan state probation solely because marijuana remains illegal under federal law.

But don’t misunderstand this ruling:

  • It applies to Michigan state probation not federal probation.
  • You must still follow all other conditions of your probation.
  • Marijuana use that violates Michigan law is not protected.

This decision does not give everyone on probation unlimited permission to use marijuana. Every case is different, and violating your probation can still have serious consequences.
