Proposed Michigan legislation changing preliminary examinations in criminal casesThe bill would allow prosecutors to rely on hearsay and summary testimony from police officers and investigating detectives at preliminary examinations instead of calling actual witnesses to testify.

Preliminary examinations have long served as an important safeguard, requiring prosecutors to present enough evidence to establish probable cause before a case moves forward. This change would significantly weaken that safeguard by allowing cases to proceed without first hand witness testimony, eliminating an important check on prosecutorial authority.
