Satawa Law Wins a Major Victory in a Shaken Baby Syndrome / Abusive Head Trauma Case

Satawa Law recently won a huge victory in a large and complex shaken baby syndrome/abusive head trauma case. The client, a young father just starting a family, was accused in a child protection termination of parental rights case of intentionally shaking and abusing his young infant son.

The young infant had seizures one day, and the parents called 911. The child was taken to a local hospital, where he was breathing and acting normally upon admission. The hospital diagnosed BRUE (Brief Resolved Unexplained Event) and released the infant the same day. Two days later, the parents took the child to their pediatrician, who agreed and said she could not see anything wrong with the infant.

Four days later (six days after the first hospital admission), the infant had seizures again while in the care of the father. This time the seizures were far more intense and serious. The child was taken to the hospital and then transferred to Mott Children’s Hospital, where they found subdural hematoma, mixed density fluid (which was explained as a heptohygroma), and retinal hemorrhaging (but only in the right eye). The infant was immediately diagnosed with abusive head trauma.

Following an intense and bitterly contested trial, the petition was dismissed, and the father got his life and family back and was reunited with his son.
